Decisions about the care for an aging parent or a spouse are among the most difficult for any family. Conflicts arise when the person in need of care doesn’t realize it or won’t admit it.
I am Martha J. Karnopp, a Denver elder law attorney offering nearly 20 years of experience in end-of-life legal issues, including guardianships and conservatorships. Preparing for the Unexpected
In addition to wills and trusts to pass your wealth to the next generation, I can help you draft the documents to see that you are cared for in case of incapacity. This includes drafting:
- An advance health care directive (living will) to dictate wishes about life-sustaining measures
- Powers of attorney for designated persons to make medical and financial decisions
Consult an elder law attorney before transferring assets to children when you or your spouse are in failing health. The Community Spouse Resource Allowance enables the healthy spouse to retain living expenses when the other spouse goes on Medicaid, and does not require you to spend down all assets.
Guardianships and Conservatorships
In the best of circumstances, we know when the time is right to enter a long-term care facility or agree to assisted living arrangements. Ideally, we have also designated a guardian to oversee our personal care and a conservator to handle our finances.
Unfortunately, this is not always the case. Martha J. I will help you petition the court for guardianship of your loved one by you, a family member or a neutral party.
I also am called upon to protect clients from their own greedy children. We can petition the court for someone else to be named guardian and conservator to ensure that your best interests are served.
